Community Guidelines and User Content
1 Community Features and Eligibility
The Bucket List Studios mobile application offers community social features (the “Community”) that allow users to post content, including text, images, videos, comments, and other materials. By accessing or using these Community features, you agree to abide by the following Community Guidelines, which exist to maintain a safe, respectful, and lawful environment for all users. Eligibility: The Community is intended for users who are 18 years of age or older. By participating in the Community, you represent and warrant that you are at least 18 years old. The Bucket List Studios will not knowingly collect personal information from anyone under that age.
1.2 Acceptable Use and Prohibited Content
When engaging with the Community, you agree to conduct yourself in a civil and respectful manner and to use the Community only for lawful and appropriate purposes. You must not post, upload, share, or transmit any content or otherwise engage in any behavior that:
- Is unlawful, encourages or facilitates illegal activity, or violates any applicable law or regulation. This includes content that promotes, depicts, or encourages the use of illegal substances or activities, or the purchase or use of firearms, weapons, or any dangerous materials.
- Is defamatory, fraudulent, abusive, or harassing, including bullying, stalking, threats, or direct attacks on any person or group. You may not use profanity, vulgar language, or slurs to insult, intimidate, or demean others.
- Constitutes hate speech or discrimination. Content that incites hatred, promotes bigotry, or disparages any individual or group on the basis of race, color, ethnicity, national origin, religion, sex, gender, sexual orientation, age, disability, or any other legally protected characteristic is strictly prohibited.
- Is obscene, pornographic, or sexually explicit. You may not post content containing nudity, graphic sexual descriptions, or any other adult material inappropriate for a general audience. Likewise, content that depicts extreme or graphic violence, gore, or other disturbing imagery is not allowed.
- Infringes or violates the rights of others. You must not post any content that violates another party’s intellectual property rights (such as copyright, trademark, or trade secret rights). This means do not upload content you did not create or do not have permission to use. Similarly, do not post content that violates anyone’s privacy or publicity rights, including personal or sensitive information about another individual (for example, someone’s address, phone number, email, financial information, or personal images) without their consent.
- Is spam, commercial solicitation, or off-topic promotion. The Community is intended for genuine information-sharing and discussion, not unsolicited advertising. You agree not to post unauthorized or irrelevant commercial promotions, junk mail, chain letters, pyramid schemes, or any other form of solicitation or automated mass messaging.
- Contains malicious code or disrupts the Service. You must not post any content that contains viruses, malware, or other code that could harm the Service or any user’s devices, or otherwise attempt to disrupt, impair, or gain unauthorized access to our platforms or another user’s account or data.
These examples of prohibited content and conduct are not exhaustive. Any content or behavior that we, in our sole judgment, find unlawful, harmful, or objectionable, or which violates the letter or spirit of these Community Guidelines, may result in enforcement action. The Bucket List Studios maintains a zero-tolerance policy for serious violations: if you violate these Community Guidelines or any other provision of these Terms, we may take immediate action, including removal of the offending content and suspension or automatic termination of your account without prior notice. In addition, severe or repeated violations can result in permanent account cancellation and a ban from using the Community or any other aspect of the Service. We may also, where appropriate or required by law, report any illegal content or conduct to law enforcement authorities. If you become aware of content that you believe violates these Guidelines or other Terms, please notify us at support@bucketlist.team or through the in-app reporting functions so that we can review and take appropriate action.
1.3 User Content Ownership and License
Ownership: The Bucket List Studios does not claim ownership of the content (including posts, answers, images, videos, or other material) that you submit or post in the Community (“User Content”). You retain all ownership rights in and to your User Content. Nothing in these Terms will be construed to restrict your rights to use your own content.
License to The Bucket List Studios: However, by submitting or posting User Content on or through our Service, you hereby grant The Bucket List Studios, Inc. and its affiliates a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sub-licensable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, and publicly perform your User Content for the purpose of operating, expanding, promoting, and improving the Service and our business. This license allows us, for example, to display your questions, answers, and posts to other users, to reformat or edit your content as needed for technical or aesthetic reasons, to feature or promote your contributions within the app or in our marketing materials, and to store backup copies of your content on our servers. You agree that this license includes the right for us to make your content available to other companies, organizations, or individuals (such as our service providers or partners) with whom we work to deliver the Service, and to otherwise use your content for the stated purposes. This license remains in effect for as long as your User Content is available on the Service and for a reasonable period of time afterward (to allow for routine backup and removal) or as required by law. If you delete or remove your User Content from the Community, or if your account is terminated, we will cease public display of your content; however, you acknowledge that cached or backup copies of your content may persist and that content you have shared with others (for example, if another user re-posted or quoted your content) may remain available to those other users unless they also delete it.
Your Warranties and Responsibilities: You are solely responsible for all User Content that you choose to post or share via the Community, and you assume all risks associated with it, including anyone’s reliance on its accuracy or claims. By posting any User Content, you represent and warrant that: (a) you either own or have obtained all necessary rights and permissions to post or submit such content and to grant the license above; (b) your posting of the content (and our use of it in accordance with these Terms) does not and will not violate or misappropriate the rights of any third party (including copyrights, trademarks, trade secrets, moral rights, privacy rights, publicity rights, or any other legal rights); and (c) the User Content complies with these Terms and all applicable laws. You agree not to upload or share any content you do not have the full right to use. You further agree to indemnify and hold harmless The Bucket List Studios for any claims, losses, or damages arising out of or related to your User Content or any breach of your representations and warranties in this section (as detailed in Section 8 of these Terms). Nothing in this section shall be construed to limit any rights or legal remedies that The Bucket List Studios may have against users who violate these obligations.
1.4 Content Monitoring and Enforcement Rights
No Endorsement or Obligation to Monitor: User Content in the Community is generated by our users and does not reflect the views or opinions of The Bucket List Studios. We do not endorse, guarantee, or assume any responsibility for any User Content, and we are not obligated to pre-screen or monitor content posted by users. You understand that, by using the Community, you may be exposed to content that you find objectionable, offensive, or inaccurate. Your use of or reliance on any User Content is at your own risk.
Our Moderation Rights: The Bucket List Studios reserves the right (but has no obligation) to monitor, review, screen, and moderate any activity or content in the Community. We may, at our sole discretion, remove, edit, or refuse to publish any User Content for any reason or no reason, including (but not limited to) content that we determine violates these Community Guidelines, the Terms, or is otherwise objectionable. We also reserve the right to limit, suspend, or terminate any user’s access to the Community features or to the Service entirely, at any time and at our sole discretion, particularly if a user has violated these Guidelines or any other provision of the Terms. Such enforcement actions may include content removal, warning notifications, suspending Community privileges, or completely deactivating your account. The Bucket List Studios shall not be liable for any such removal or account action, and we may do so with or without prior notice to you. In enforcing these Guidelines, The Bucket List Studios may also cooperate with law enforcement or other authorities (consistent with our Privacy Policy and applicable law) if your content or behavior is unlawful.
Community Integrity: We expect all users to help us maintain a trustworthy and positive Community environment. If you witness or experience any content or behavior that you believe violates these Community Guidelines or other Terms, we encourage you to report it to us. We will review all reports and take appropriate action at our discretion. You acknowledge that enforcement of these Guidelines is necessarily a matter of judgment, and the Company’s decision in any matter involving the Community is final and binding. By participating in the Community, you agree to abide by these rules and understand that any violation may result in the loss of your privileges to use the Community or the Service.
